terms of service.

INTRODUCTION

Parties:
“We”; “Our” – refers to House of VèSè.  
“You”; “Your” – refers to you, the client. 

Terms:
“website” – refers to the online website (houseofvese.com) used by House of VèSè to display and sell all VèSè artwork.
“client” – refers to any person browsing or purchasing products on the House of VèSè online website. 

"in-store" - refers to the Collaro furniture showroom in Kramerville, Sandton.  

By accessing and browsing this website, you agree to the following Terms and Conditions (Ts & Cs) and agree to be bound by them.

These Ts & Cs will apply to all orders concluded by or with House of VèSè for the sale of any VèSè artwork, whether in-store or on our website.  

House of VèSè provides its services to you subject to the following Ts & Cs:

PRODUCT INFORMATION:

Not all VèSè artwork will be displayed on the House of VèSè website. We will however try our best to update the website as often as possible to display the latest VèSè artworks.

Should you see a VèSè artwork in-store or on our Instagram page, which is not displayed on our website, you may request more information on same by either getting in contact with us via our email address or Instagram page displayed in the Contact Us page of our website. 

 

Most (but not all) VèSè artworks are displayed and available to view and purchase in person in-store.

 

If an artwork is not on display in-store and you wish to view it in person before purchasing same, you may request from one of the Collaro consultants to have that artwork brought in-store. 

Kindly allow up to 10 (ten) business days for the requested artwork to be brought in-store for you to view. 

 

While we make every effort to ensure that the artwork(s) you purchase online (including print colour and type of timber of framing) correspond as closely as possible to the pictures shown on our website, slight discrepancies may occur due to photography and viewing-device screens.

 

It is very unlikely, but some prints may come with slight defects. These defects could make your print more rare and valuable. 

It is even more unlikely, but some prints may be damaged for whatever reason whatsoever. 

Should you be unhappy with a "damaged" print at receipt of delivery, you may bring same in-store and request to have same inspected. 

Upon inspection of a "damaged" print we have the sole discretion to decide whether it is damaged or simply defective.

It may take up to 10 (ten) business days for a print to be inspected.

 

A defective print would be one that has some kind of printing error caused by machine and cannot be fixed.

A damaged print would be one that has been torn, creased, folded, spoilt by water, or something similar in nature, caused by human error or negligence.  

 

If the print is deemed to be damaged then the client may request to have it replaced. 

 

All VèSè artworks are limited to a specific number of prints. This means that if your print is deemed to be damaged, then we will replace it with another print of the same artwork. However, because all the artworks are limited you will NOT receive the same numbered print. Rather, you will receive a different numbered print and the damaged print will be kept in our possession until we decide what to do with it. 

If there are no more prints available of that artwork, a client with a damaged print will have the choice of keeping the damaged print OR receiving a refund. Delivery fees, will not be included in this refund amount. 

Damaged prints will be replaced in accordance with the above. 

Defective prints will not be replaced. 

 

Should a frame be damaged BEFORE receipt of delivery, the client can bring the artwork in-store and we will do our best to fix the damaged frame free of charge. 

Should a frame be damaged AFTER collection or receipt of delivery, we will NOT be responsible to fix the damaged frame. 

PRICES & METHODS OF PAYMENT:

All prices displayed in-store and on the website are quoted in South African Rands (ZAR) and include Value Added Taxation (VAT). 

Should there be a difference in price between a price displayed in-store and on the website, for whatever reason whatsoever, we reserve the right to amend the price to the correct price.

If a price is displayed incorrectly, for whatever reason whatsoever, then we reserve the right to amend the price to the correct price, and, as a result, either charge the client the remainder of the shortfall amount or reimburse the client the overpaid amount.

 

We will not be forced to honour an incorrectly displayed price.

The products and prices that are displayed on this website and in-store may change without notification and are subject to availability. House of VèSè and its agents will not be held responsible for any misstatements or errors that may emanate from this website. 

 

We will try our hardest to make sure that all prices displayed are correct but clients must understand that human errors are sometimes made and can be rectified upon being made aware of same.  

Full payment of the purchase price is required before any artwork can be shipped to the client.

The product(s) will remain the property of House of VèSè until payment is received in full.

All major credit cards are accepted on our website. 

EFT payments and cash payments are only accepted for in-store purchases at Collaro. Proof of payment must be forwarded to the sales consultant who assisted you. Please allow up to 3 (three) business days for the receipt of EFT funds to be received by Collaro

Artwork(s) will only be released for collection once House of VèSè has received the funds. 

Clients will only be eligible to take artwork home from Collaro if it is purchased in-store and Collaro has received the funds. 

DELIVERY & COLLECTION POLICY:

Clients have the option of choosing a delivery option or a collection option upon purchasing an artwork online or in-store. 

If an artwork is in stock in-store, clients are able to purchase ​the artwork(s) and may conclude collection of same in accordance with the provisions of the Prices & Methods of Payment clause above. 

If an artwork is not in stock in-store, clients can order same and request to either collect the artwork(s) from the Collaro showroom or have the artwork(s) delivered to their chosen address in accordance with the provisions of the Prices & Methods of Payment clause above

If an artwork is purchased online, clients can request to either collect the artwork(s) from the Collaro showroom or have the artwork(s) delivered to their chosen address in accordance with the provisions of the Prices & Methods of Payment clause above. . 

If a client chooses the collection method, they must collect the artwork(s) from the Collaro showroom at 2 Desmond Road, Kramerville, Sandton. 

Clients must allow for up to 10 (ten) business days for orders to be ready for collection. 

Once the order is ready for collection, clients will be notified via email. 

If a client chooses the delivery method, they will be charged R1 000.00 (one thousand Rand) for each framed artwork ordered. This delivery fee includes crating and delivery of the artwork(s).

Unframed prints will be delivered free of charge.  

Clients must allow for up to 10 (ten) business days for orders to be delivered to the client's chosen delivery address. 

It is your duty to inspect your artwork(s) immediately upon receipt of delivery for any defects or damage.

Should you inform us of any defects or damage to a print or the frame within 24 (twenty-four) hours of receiving delivery we will conduct an inspection in accordance with the provisions of the Refunds, Returns & Cancellations clause below. 

 

It is your duty to inspect your artwork(s) for any defects or damage before concluding collection.

Once collection of an artwork has been concluded, we will not be responsible for any damage cause to the artwork. 

Upon collection, all risk in the product passes to the customer.

RISK & LOSS:

The risk of loss and title passes to you, as the client, upon collection or receipt of delivery of the artwork(s). 

Once you have collected the artwork(s) from Collaro's premises, you unconditionally agree and accept that the risk of loss for those items passes on to you at the time of collection.

REFUNDS, RETURNS & CANCELLATIONS:

All VèSè artwork is limited and printed and framed specifically for clients when they place and order.

House of VèSè does not keep stock of artwork and so, no orders will be eligible for refunds or exchanges as they have been manufactured specifically for you. 

You may not cancel your order as printing of artwork and manufacturing of the frame will have commenced once payment has reflected.

CONDITION OF DISPLAYED ARTWORK:

If you are purchasing an artwork on display, in-store, straight off the floor (as viewed by you), the artwork is sold to you in the specific condition in which it is in.

 

Your purchasing the item will constitute your acceptance of the artwork and its condition.

ERRORS:

Should any of the pricing of our artwork display any obvious errors, we will correct the error as soon as we have been notified of it.

 

House of VèSè and its agents will not be bound by the incorrect price. 

LICENSE & SITE ACCESS:

House of VèSè grants you a limited license to access and make personal use of this site and not to download (other than page caching) or modify it.

This license does not include any resale or commercial use of this site or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.

This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of House of VèSè.

You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including Images, text, page layout, or form) of House of VèSè and our affiliates without express written consent. 

All images of artwork displayed on this website belong to House of VèSè. 

No one is authorised to download, save or screenshot the artwork on this website and print it for themselves or for others or sell any VèSè artwork for their own personal gain. 

All VèSè artwork is sold will a certificate of authenticity. Please refer to the Authenticity page for more information. 

INDEMNIFICATION: 

House of VèSè and any of its representatives or agents will not be liable for any loss, damage or liability of any kind arising from the use or inability to use this Site or the services or content provided through or from this Site. 

ELECTRONIC COMMUNICATION:

You consent to receive communications from us electronically.

 

We will communicate with you by e-mail or by posting notices on this site.

 

You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

SHARING PERSONAL INFORMATION: 

House of VèSè will not share, transfer, sell or disclose any of your personal information with any other entity or person without your consent.

AMENDMENTS TO THESE TERMS & CONDITIONS:

House of VèSè may, at any time, amend any of the above Terms and Conditions without notice.

 

It is your responsibility to check them regularly and make sure that you are satisfied with the changes.

 

Should you not be satisfied, you must not place any orders on the Site, and you must not in any other way use it.

 

If any condition is deemed for any reason unenforceable, void or invalid, the condition will be deemed severable and will not affect the enforceability and validity of the remaining condition(s).

GENERAL:

Unless any applicable law prescribes otherwise, our Terms and Conditions and any agreement made with House of VèSè to buy any artwork(s), shall be governed by prevailing South African law.
